Agreement and operator

GonzoWorks LLC, a California limited liability company (“GonzoWorks,” “we,” “us”), operates GonzoArcade. By accessing or using the portal, you agree to these terms and the Privacy Policy. If you do not agree, do not use the portal.

If you are under the age of legal majority where you live, use the portal only with permission and supervision from a parent or legal guardian. Children may not make donations.

Passion project and independent games

GonzoArcade is a passion project and catalogue, not a promise that any title will be released or remain available. Each game is independently defined, built, versioned, hosted, and governed. Its features, controls, content, availability, requirements, saves, privacy practices, and rules may differ from the portal and from other games.

Unless a game’s own page says otherwise, all titles are works in development. Previews, features, roadmaps, names, domains, release plans, and availability may change, pause, reset, or be withdrawn at any time.

Limited personal-use license

Subject to these terms, GonzoWorks grants you a limited, revocable, non-exclusive, non-transferable license to access the portal and publicly available games for personal, non-commercial entertainment or learning. No ownership rights are transferred.

You may not interfere with service operation; bypass access controls; introduce malware; scrape at a disruptive rate; exploit a vulnerability; impersonate another person; use the service unlawfully; or copy, sell, redistribute, reverse engineer, or create derivative works from protected content except where applicable law or a separate open-source license permits it.

Games, saves, and content

Development builds may contain defects, unfinished systems, changing controls, temporary content, balance changes, or save incompatibilities. You are responsible for checking a game’s requirements and notices. We do not guarantee that progress, settings, accounts, or saved data will remain available.

Games may include fantasy conflict, stylized combat, motion, sound, flashing effects, humor, or educational themes. The portal’s previews are not age ratings. Parents should review each game before a child plays. See Game Notices.

Donations

Donations are voluntary support for the project. They are not purchases, preorders, subscriptions, investments, charitable contributions, ownership interests, or guarantees of any game, feature, reward, release, or delivery date. PayPal processes the transaction under its own terms. The Donation Policy is incorporated into these terms.

Intellectual property and feedback

The portal, branding, code, text, graphics, videos, and game content are owned by GonzoWorks or used with permission, except for third-party or open-source material identified by its own notice. “GonzoArcade” and related names and designs may be trademarks or brand identifiers of GonzoWorks.

If you voluntarily send ideas or feedback without a separate written agreement, you grant GonzoWorks a worldwide, perpetual, irrevocable, royalty-free right to use, adapt, and commercialize that feedback without compensation or confidentiality obligations. Do not send confidential or proprietary material.

Third-party services

Links to PayPal, games, repositories, or other sites are provided for convenience. We do not control third-party terms, content, security, privacy, uptime, or transactions and are not responsible for them. A link is not an endorsement of every statement or service at the destination.

Disclaimers

To the maximum extent permitted by law, the portal and games are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, availability, or uninterrupted or error-free operation.

Educational or simulation content is for entertainment and general information, not professional, medical, legal, financial, engineering, laboratory, or safety advice. Do not use a game as instructions for real-world activities.

Limitation of liability

To the maximum extent permitted by law, GonzoWorks and its members, contractors, contributors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, progress, revenue, profits, goodwill, or use arising from the portal, a game, or a linked service.

To the maximum extent permitted by law, total liability for claims connected with the portal will not exceed the greater of the amount you paid GonzoWorks for the specific service giving rise to the claim during the preceding 12 months or US $100. This limitation does not exclude liability that cannot lawfully be excluded or limited, and nothing in these terms waives non-waivable consumer rights.

Suspension, changes, and governing law

We may restrict or terminate access when reasonably necessary for security, maintenance, legal compliance, abuse prevention, or project changes. We may revise these terms by posting an updated version and effective date; continued use after the effective date means you accept the revised terms.

California law governs these terms, without regard to conflict-of-law principles, except where your local law requires otherwise. Courts with lawful jurisdiction in California may hear disputes, subject to any non-waivable rights you have where you live. These terms contain no mandatory arbitration or class-action waiver.
